Terms of service

Effective Date: 03 November 2025

Stichting Mental Health and Psychosocial Support Academy (hereinafter referred to as the “Organization,” “MHPSS Academy,” “we,” “us,” or “our”) is a non-profit organization established under the laws of the Netherlands. These Terms of Service (“TOS”) govern your access to and use of our website, any services you purchase, and any free digital content you receive.

  1. Acceptance and Agreement

By accessing or using any part of the website, signing up for our newsletter, joining the Bridge network, registering for a webinar, or purchasing any course or consulting service, you agree to be bound by these TOS and our separately published Privacy Policy. If you do not agree to these terms, you must not use our website or services.

  1. Scope of Services and Critical Disclaimer

2.1 Service Definition

The MHPSS Academy provides professional development services, including: (a) Training Courses: Online (live, synchronous) or in-person educational sessions focusing on MHPSS interventions and professional capacity strengthening. (b) Organizational Consulting: Advisory services provided to organizations and institutions (NGOs, agencies, etc.) under separate, specific statements of work (SOWs) or agreements, (c) Networking: Free offer to join a Community Platform for MHPSS professionals working with scalable interventions. Offer to join live webinars or listen to pre-recorded podcasts on topics relevant to MHPSS scalable interventions. Offer to receive regular newsletter with updates on upcoming events or other relevant news.

2.2 CLINICAL DISCLAIMER AND LIMITATION OF LIABILITY (CRUCIAL)

The MHPSS Academy and its consultants do not engage in clinical treatment, psychotherapy, medical diagnosis, or patient care. The services provided are for educational instruction, professional capacity building, and psychosocial support purposes only. Our services are not a substitute for professional clinical supervision, psychiatric care, or emergency mental health services. The Client remains solely responsible for all professional decisions, patient/client outcomes, and clinical conduct following the use of our services.

  1. Registration, General Use, and Privacy

3.1 Website, Newsletter, Webinars and Podcasts

(a) General Access: These TOS apply to all public use of the MHPSS Academy website. (b) Newsletter Sign-up: By signing up for our newsletter, you consent to receive communications from the Organization. You may unsubscribe at any time. (c) Webinar/Free Event Participation: Participation in free webinars and events is subject to these TOS, particularly the IP and Conduct clauses (Sections 4 and 5).

3.2 Privacy Policy Reference

Your submission of personal data through the website or services is governed by our Privacy Policy, which is accessible separately with this link.  By agreeing to these TOS, you acknowledge that you have read and accepted the terms outlined in the Privacy Policy.

  1. Fees, Payment, and Refund Policy

4.1 Fee Structure and Payment

(a) Paid Services: All course fees are charged as a one-time fee per course or per consulting engagement (as defined in the SOW). (b) Payment Due: Payment is due upon registration or as specified in the corresponding invoice.

4.2 Refund and Cancellation Policy

(a) Refund Eligibility: The Client may request a full refund up to 14 calendar days before the pre-training meeting (or the official course start date, whichever is earlier). All refund requests must be made in writing. (b) Cancellation After Deadline: No refunds will be issued after the 14-day pre-training deadline has passed. (c) No Refund After Access: No refunds will be issued once the Client has accessed any part of the course content, materials, or attended any portion of the live training. (d) Goodwill Consideration: In the event the Client is unable to complete a course due to verified exceptional circumstances, the Organization may, at its sole and absolute discretion, offer the Client access to a comparable future course as an alternative to a financial refund.

  1. Intellectual Property (IP) and Content Usage

5.1 Ownership

All course methodologies, training materials, presentation slides, recorded sessions, logos, and website content (collectively, “IP”) are the exclusive property of the Stichting Mental Health and Psychosocial Support Academy and are protected by copyright and intellectual property laws.

5.2 Permitted Use

Upon enrollment, the Client is granted a limited, non-transferable, non-exclusive license to use the PDF versions of the presentation slides and shared written materials solely for the Client’s personal, professional development.

5.3 Prohibited Activities (Strict Enforcement)

The Client is STRICTLY PROHIBITED from: (a) Recording: Recording, capturing, or reproducing the live synchronous training sessions by any means (audio or video). (b) Sharing/Distribution: Sharing, distributing, selling, sub-licensing, or otherwise making available any part of the IP, including the PDF slides, recordings, or access links, to any third party. (c) Commercial Use: Using the IP to conduct similar training, consulting, or commercial services, whether for profit or not-for-profit.

  1. Governing Law and Jurisdiction

These Terms of Service, along with any separate agreements (like SOWs), shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions. Any dispute arising out of these TOS shall be resolved by the competent court in Amsterdam, The Netherlands.
